This Charter shall be read with the Terms and Conditions placed on our Website www.quickcarehealth.com and shall be construed as an integral part of the Terms and Conditions.
RIGHTS:
The Doctors and/or other Healthcare Personnel have the right to be treated with dignity and respect with regards to the Services provided by them to the Patients using the Online Platform.
The Doctors and/or other Healthcare Personnel have the right to be informed with the complete, accurate and genuine information of the Patients which shall be deemed true to the best knowledge of the Doctors and/or Healthcare Personnel and shall include the details of any previous ailments, previous diagnosis of ailments, previous hospitalizations, any ayurvedic treatments undergone, allergies, the prescribed medicines and the drugs for the ailments diagnosed, homeopathy medicines taken if any to avoid any false diagnosis and any medicine reactions. Extra care shall be taken by the Doctors and/or other Healthcare Personnel in case of vulnerable Patients.
The Doctors and/or other Healthcare Personnel have the right to refuse treatment to any of the Patients who refuse to cooperate, do not follow the treatment plans and packages promptly and ill- treat or manhandle the Doctors and/or other Healthcare Personnel.
The Doctors and/or other Healthcare Personnel shall have the right to disclose such information of the Patients to the competent party with prior consent of the Patients as per the requirement and shall disclose such information for fair and reasonable reasons which may relate to the treatment, health and safety of the Patients. In furtherance to the same, the Doctors and/or other Healthcare Personnel shall have the right to maintain a record of the Patients to whom they are providing such Services using the Online Platform.
The Doctors and/or other Healthcare Personnel shall have the right to choose any alternatives with regards to the treatments of the Patients which would be more feasible and appropriate for the Patients based on the needs of the Patients and shall keep the Patient informed of the same.
RESPONSIBILITIES:
The Doctors and/or other Healthcare Personnel shall treat the Patients with respect and dignity. The Doctors and/or other Healthcare Personnel shall be courteous and shall act professionally with the Patients. They should ensure to communicate the pros and cons of the treatment to the Patients and should provide various other alternatives available to the Patients.
The Doctors and/or other Healthcare Personnel shall be solely responsible for any misconduct, medical negligence and for having ill-treated any of their Patients or Users availing the Services using the Online Platform.
The review of any reports or the making of any reports by the Doctors shall be proper and shall be promptly done by the Doctors and/or other Healthcare Personnel. The Doctors and/or other Healthcare Personnel shall be solely responsible for any false reviewing or making of any reports based on the medical records of the Patients.
The Doctors and/or other Healthcare Personnel shall be responsible for providing proper medication to the Patients and shall ensure that such medication does not cause any adverse effects which would cause any damage to the Patients and shall keep the Patients well informed about the foreseeable risks, advantages and disadvantages with regards to the same. The Doctors and/or other Healthcare Personnel shall follow up with the Patients with regards to the treatments so provided within the stipulated time frame of the treatment procedure.
The Doctors shall not disclose any information that is considered to be privileged communication between the Doctors and the Patients unless there is a requirement of such disclosure to such competent authority and/or unless the patients waive off their confidentiality of the information so provided by them to the Doctors.
The Doctors shall be required to maintain a valid MCI registration number and professional indemnity insurance and must keep it renewed every year. The evidence of the same shall be presented to the Company as and when required.
The Doctor shall abide by all the laws enforceable in India including but not limited to Indian Medical Council (Professional conduct, Etiquette and Ethics) Regulations, 2002, Drugs and Cosmetics Act, 1940; Pharmacy Act, 1948; Narcotic Drugs and Psychotropic substances Act, 1985; Medical Termination of Pregnancy Act, 1971; Transplantation of Human Organ Act, 1994; Mental Health Act, 1987; Environmental Protection Act, 1986; Pre–natal Sex Determination Test Act, 1994; Drugs and Magic Remedies (Objectionable Advertisement) Act, 1954; Persons with Disabilities (Equal Opportunities and Full Participation) Act, 1995 and Bio-Medical Waste (Management and Handling) Rules, 1998 and such other Acts, Rules, regulations made by the central/state governments or local administrative bodies or any other relevant act relating to the protection and promotion of public health.
The Doctors and/or other Healthcare Personnel should ensure that the Patient is providing free and informed consent with respect to any treatments and that there is no force or coercion involved with regards to the procedure of treatment of the Patients.
It is the responsibility of the Doctors and/or other Healthcare Personnel to keep the Patients informed about the chances of the success and the failure with respect to the treatments being initiated by them and help the Patients to be prepared with respect to the same and the Doctors and/or other Healthcare Personnel shall be solely liable for any medico legal cases initiated by any of the Patients and/or Users in the event of any medical negligence by the Doctors and/or other Healthcare Personnel.
